These Terms of Service (“Terms”) govern your use of the Sisu mobile application (the “App”), operated by Sisu Ascent LLC (“we,” “us,” or “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use Sisu. The App provides fitness, nutrition, and supplement-related content intended for adults.
2. Not Medical Advice — Health & Safety Disclaimer
Sisu is a fitness and nutrition tracking tool, not a medical service. The App — including its calorie/macro calculations, workout suggestions, progressive-overload and 1RM estimates, supplement and peptide information, AI-generated meal plans, recipes, and guidance — is provided for general informational and educational purposes only. It is not medical, nutritional, or professional health advice and is not a substitute for consultation with a qualified physician, registered dietitian, or other licensed professional.
- Consult a professional before starting any diet, exercise program, supplement, or peptide regimen, especially if you are pregnant, nursing, under 18, elderly, or have any medical condition or take medication.
- Supplement and peptide content is informational only. We do not sell, prescribe, or recommend that you take any substance. Some substances referenced may be regulated, require a prescription, or be prohibited in your sport or jurisdiction. You are solely responsible for the legality and safety of anything you choose to consume.
- Stop and seek help if you experience pain, dizziness, or any adverse symptom while exercising or following any plan.
- You assume all risks associated with physical exercise and dietary changes. To the fullest extent permitted by law, we are not liable for any injury, health consequence, or loss resulting from your use of the App.
3. AI-Generated Content
Some features use artificial intelligence (provided by Anthropic) to generate estimates, recipes, meal plans, and guidance. AI output may be inaccurate, incomplete, or unsuitable for your circumstances — including calorie/macro estimates and nutritional content. Always use your own judgment and verify important information. Do not rely on AI output for medical, dietary, or safety-critical decisions.
4. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Provide accurate information and keep it current.
- Notify us promptly of any unauthorized use.
- You may delete your data and account at any time within the App or by contacting us.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms;
- Attempt to access other users’ data, or probe, scan, or breach security;
- Reverse engineer, decompile, or interfere with the App except as permitted by law;
- Upload content that is unlawful, infringing, or harmful;
- Use the App’s AI features to generate prohibited, harmful, or abusive content;
- Publish objectionable content or harass, abuse, or harm other users (see Section 6A).
6. Your Content
You retain ownership of the data and content you enter (meals, workouts, photos, notes, recipes, etc.). You grant us a limited license to store, process, and sync that content solely to operate the App for you. You are responsible for the content you provide.
If you choose to share or publish content to the community (for example, by publishing a recipe to the public community library or sharing it via a share code), Section 6A applies, and you grant us and other users the rights described there.
6A. Community Content, Conduct, and Zero-Tolerance Policy
Sisu lets you publish and share certain content, such as recipes, with other users (“Community Content”). This section, together with Section 5 (Acceptable Use), forms our end-user license agreement governing community content and conduct.
License to share. When you publish Community Content, you grant Sisu Ascent LLC and other users a worldwide, non-exclusive, royalty-free license to view, store, copy, and use that content within the App. You can remove (unpublish) content you posted at any time; copies other users already saved to their own libraries may remain with them.
Your representations. You represent that you own or have the rights to the content you publish, that it is accurate to the best of your knowledge, and that publishing it does not violate any law or third-party right.
Zero tolerance for objectionable content and abusive behavior. You agree not to publish, share, or transmit content, or engage in conduct, that is: unlawful; hateful, harassing, threatening, defamatory, or abusive; obscene, sexually explicit, or pornographic; violent or that promotes self-harm, disordered eating, or other dangerous practices; that promotes unsafe, prohibited, or unapproved substances or dosing; infringing of intellectual-property or privacy rights; spam, fraudulent, or deceptive; or that contains malware or others’ personal information. There is no tolerance for objectionable content or abusive users.
Reporting and moderation. You can report objectionable Community Content from within the App. We review reports and will remove violating content and may suspend or remove the account of an offending user, generally within 24 hours of becoming aware of a violation. You can also choose not to view content from a given user. We may remove any content or restrict any account at our discretion, with or without notice, to enforce these Terms or protect users.
No reliance. Community Content is created by other users, not by Sisu. We do not verify its accuracy, safety, or nutritional values. Use your own judgment; the health and AI disclaimers in Sections 2 and 3 apply to Community Content as well.
7. Subscriptions and Purchases
The App may offer optional paid subscriptions or features (the “Premium” service). If you purchase a subscription:
- Pricing, billing period, and any free-trial terms will be displayed at the point of purchase.
- Payment is charged to your Apple App Store account.
- Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Manage or cancel renewals in your App Store account settings.
- Refunds are handled by Apple under their policies; we generally cannot issue store refunds directly.
- Any unused portion of a free trial is forfeited if you purchase a subscription.
8. Intellectual Property
The App, including its design, branding (“Sisu,” the Ascent emblem and related marks), text, and software, is owned by Sisu Ascent LLC and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial use. You may not copy, distribute, or create derivative works without our permission.
9. Third-Party Services
The App relies on third-party services (Apple, Supabase, Anthropic, Open Food Facts, USDA FoodData Central, TheMealDB). Your use of those services may be subject to their own terms. We are not responsible for third-party services or content.
10. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data (including AI estimates and macros) will be accurate.
11. Limitation of Liability
To the fullest extent permitted by law, Sisu Ascent LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or health consequences, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50.
12. Indemnification
You agree to indemnify and hold harmless Sisu Ascent LLC from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
13. Termination
We may suspend or terminate your access if you violate these Terms or misuse the App. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (disclaimers, limitation of liability, intellectual property) will survive.
14. Changes to the App and Terms
We may modify or discontinue features, and we may update these Terms. For material changes we will update the “Last updated” date and provide notice in the App. Continued use after changes means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Texas, unless applicable law requires otherwise.
